Technical passport for an apartment, house or non-residential premises
A technical passport is a document consisting of textual and graphic materials containing information on the composition, actual area, volume, and technical condition of a real estate object, made on the basis of technical inventory materials based on the results of a technical inventory as of the date of its conduct.
Technical inventory is divided into primary or repeated
Primary is a technical inventory of a real estate object that is carried out for the first time. Usually, the primary inventory is carried out before the construction object is put into operation
Repeated is a technical inventory of a real estate object that determines changes in a real estate object over a certain period of time. This is any subsequent inventory after the initial one.
When is it necessary to prepare a technical passport?
- when performing notarial acts in relation to property
- putting a real estate object into operation
- registration of ownership of real estate
- registration, redevelopment or completion of an object
- connection of networks (water supply, electricity, etc.)
- transfer of property to a mortgage
If the technical passport was prepared several years ago, do I need to revise it?
If you do not plan to take any legal action in relation to the property in the near future, you do not need to revise the technical passport.
It is necessary to prepare a new technical passport in the following cases:
- you need to perform notarial acts in relation to the property
- you have rebuilt, completed, or redeveloped the property and want to make appropriate changes to the Register of Real Property Rights
- you plan to mortgage the property you will need to prepare a new technical passport and register it in the USREOU accordingly
In addition, in the case of large real estate objects, there are often cases when no one has been dealing with the documents and some of the documents have been lost or the information in the existing documents does not match the actual size of the real estate. In such situations, it is necessary to conduct a technical inventory, prepare a new technical passport and restore the missing documents.
If the inventory reveals the need to make changes to the ownership documents, you will be offered options on how to do so.
Who has the right to issue a technical passport of the BTI?
Technical passports are prepared by individuals – entrepreneurs or legal entities that employ one or more responsible executors of certain types of works (services) related to the creation of architectural objects, who have passed professional certification and received a qualification certificate for the right to perform works on technical inventory of real estate objects in accordance with the Law of Ukraine “On Architectural Activity”.
Whereas before 2013 technical passports were issued only by municipal BTIs, since January 2013 private legal entities and individual entrepreneurs have also been entitled to conduct technical inventory and issue technical passports.
What are the advantages of a municipal BTI?
They keep an archive of property rights that were registered before January 1, 2013, and can therefore provide a certificate or an archived copy.
Sometimes (very rarely, if the deadlines are not important) services are cheaper.
What are the advantages of private BTI?
Faster. The term of execution is from one day.
Price. You know at once how much you have to pay, there are no surcharges and pitfalls. Often, as a result, the cost of the technical passport is less than in the municipal BTI
Loyalty of engineers and the company as a whole. Unlike the municipal BTI, you will not have the risk of receiving a note on unauthorized construction/re-planning or missing documents, simply because the contractor does not want to understand and waste his time.
Quality of work. Private BTIs often employ more qualified and experienced performers, as they can be provided with competitive salaries.
Please note that technical passports issued from August 2021 onwards must be registered with the USCCB. Therefore, it is very important that the data entered into this register is correct.
