Registering ownership of a house in Ukraine

Registering the ownership of a house is a mandatory legal process that confirms the owner’s legal rights to real estate. Without proper registration, it is impossible to carry out transactions with the house, such as sale, gift or inheritance.

1. Ways to acquire ownership of a house

Ownership of a residential building may arise as a result of:

  1. Construction of a new building – if the owner has built a residential building, it must go through the commissioning procedure in accordance with the State Building Regulations and then register the ownership.
  2. Purchase of real estate – ownership is transferred after signing a notarized sale and purchase agreement and its state registration.
  3. Receiving a house as an inheritance or a gift – the title is formalized on the basis of a certificate of inheritance or a gift agreement.
  4. Privatization – if the house was state or municipal property, it can be privatized in accordance with the applicable law.

2. Documents for registration of ownership

To register ownership of a house in the State Register of Real Property Rights, you must submit

  • a document confirming the ownership (purchase and sale agreement, gift, inheritance certificate, etc.)
  • a technical passport for the building issued by the BTI or a certified engineer;
  • a decision of the authority on putting the building into operation (for new buildings);
  • receipt of payment of the administrative fee;
  • application for state registration of ownership.

3. State registration of property rights

Property rights are registered through Administrative Service Centers (ASCs), notaries or state registrars. After submitting the documents, the ownership is recorded in the State Register of Real Property Rights, and the owner receives an extract.

4. Cost and terms of registration

The amount of the administrative fee depends on the timeframe for processing the application:

  • in the general procedure (up to 5 business days) – 0.1 of the subsistence minimum;
  • in an urgent procedure (within 2 hours) – 5 subsistence minimums.

5. Consequences of failure to register ownership

If the property right is not registered, the owner will not be able to

  • sell, donate or inherit the house;
  • obtain a permit for reconstruction or rebuilding;
  • use the property as collateral for a loan.
