Reconstruction permit

The reconstruction of buildings and structures is a complex engineering and legal process that requires careful preparation and compliance with applicable laws. What is reconstruction?

According to the State Construction Norms of Ukraine (SBN) and Article 1 of the Law of Ukraine “On Regulation of Urban Development”, reconstruction is the restructuring of an existing construction project, which may include changes in its functional purpose, geometric dimensions, load-bearing structures or engineering systems. Reconstruction is different from major repairs or new construction, so it requires separate permits.

When is a reconstruction permit required?

A reconstruction permit is required in cases where it is planned to change the external or internal characteristics of an object that may affect its strength, stability or safety. For example, if it is planned to change the load-bearing walls, increase the area of the building, redevelop the premises, or upgrade the utility networks.

Pursuant to Article 26 of the Law of Ukraine “On Regulation of Urban Development Activities,” a permit is required in most cases of reconstruction, except for minor works that do not affect the load-bearing structures or safety of the building.

Stages of obtaining a reconstruction permit

  1. Development of a reconstruction project. The project documentation must be prepared in accordance with the requirements of the DBN and approved by the relevant authorities. It is advisable to engage qualified architects and engineers to develop the project.
  2. Approval of the project by local authorities. The project must be approved by the architectural and construction control authorities, as well as other regulatory authorities, depending on the specifics of the facility.
  3. Obtaining an expert opinion. The project is evaluated for compliance with building codes, safety standards and other legal requirements.
  4. Submitting an application for a permit. The application is submitted to the relevant local authority together with project documentation and an expert opinion.
  5. Obtaining a reconstruction permit. After reviewing the documents, the relevant authority issues a construction permit.

Requirements for project documentation

The project documentation for reconstruction must comply with the requirements of the DBN, as well as take into account all aspects of safety, energy saving and environmental protection. The mandatory components of the project include architectural, structural and engineering solutions, as well as security and fire protection measures.

Carrying out construction work without a proper permit can lead to serious consequences, including fines, suspension of construction work, and even forced dismantling of illegal alterations. According to Article 96 of the Code of Ukraine on Administrative Offenses, violation of urban planning legislation entails administrative liability.
