3 reasons why you can’t plan a real estate sale “for tomorrow”

It is important to keep all real estate documents in order in order to quickly sell, donate, or pledge your real estate.

However, even if you have all the necessary documents, it is often not possible to schedule a real estate sale transaction “for tomorrow.” There are three main reasons why the procedure may be delayed.

1. Illegal redevelopment

Many property owners decide to change the layout of their homes to make them more comfortable or spacious. This may include adding a balcony, combining rooms, relocating a bathroom, etc. However, if such changes have not been officially legalized and are not reflected in the technical passport, it can become a serious problem when selling.

For example:

  • Attachment of a balcony. If the balcony was added to the living space without the appropriate permits, it means that the actual area of the apartment does not match the one specified in the technical passport.
  • Relocation of the bathroom. Relocating a bathroom without approval can lead to a violation of building codes, which complicates the sale process.

To avoid delays, it is necessary to legalize all changes in the layout in advance and obtain a new technical passport reflecting the current state of the property.

2. Old technical passport

The technical passport is a key document that contains all the necessary information about the property, including its layout, area and other technical characteristics. If the technical passport is outdated, it can cause delays in the alienation of real estate.

According to the new requirements, all technical passports must be entered into the Unified State Electronic System in the Field of Construction (USESC). Without this, the alienation of real estate becomes impossible. Therefore, before selling, it is necessary to check whether the technical passport meets modern requirements and, if necessary, obtain a new one.

3. Information on ownership is not entered in the State Register of Real Property Rights

Another reason why a real estate sale transaction may be delayed is the lack of information on ownership in the State Register of Real Property Rights. Entering such information can take from several minutes to several months, depending on the specific situation.

For the transaction to be successful, it is necessary that all ownership data be entered into the register in advance. This ensures the legal purity of the transaction and guarantees that the new owner will not have any problems with the registration of their rights to the property.

To summarize

Preparing for the sale of real estate requires a thorough check and updating of all necessary documents. Illegal redevelopment, an old technical passport, and the absence of information on ownership in the State Register of Property Rights can significantly delay the process.

Therefore, it is important to contact a specialist in advance to check and execute all the necessary documents.
