Forestry Fund Lands
Forestry Fund Lands are a category of land with a special legal status and significant ecological and economic importance. They are mainly used for forestry management, forest protection and regeneration, as well as for other purposes defined by law.
Definition and Legal Status
According to Article 55 of the Land Code of Ukraine, forestry fund lands include:

lands covered with forest vegetation;
-
lands not covered with forest vegetation, intended for forest regeneration;
-
other lands allocated for forestry purposes.
According to the Forest Code of Ukraine, these lands are under state protection, and their use must comply with environmental safety standards and sustainable development principles.
Purpose and Restrictions
Forestry fund lands are primarily intended for forestry purposes. Changing their intended use is only possible with a justified basis and upon approval from forestry and environmental authorities. In particular, Article 20 of the Land Code prohibits unauthorized changes in land use designation.
In addition, according to DBN B.2.2-12:2019 “Planning and Development of Territories”, construction on forestry fund lands is allowed only in exceptional cases — for example, for forestry facilities or infrastructure that does not contradict the area’s environmental protection status.
Use and Lease of Forestry Lands
Forestry fund lands can be granted for:

permanent use (to state forestry enterprises);
-
lease (subject to forestry management conditions).
Lease agreements for forest plots are regulated by the Law of Ukraine “On Land Lease” and by special conditions established by the State Forest Agency.
The registration of rights to such plots usually requires land management documentation and registration in the State Land Cadastre, as provided by the Law of Ukraine “On the State Land Cadastre”.
Withdrawal and Change of Purpose
The procedure for withdrawing forestry fund lands for non-agricultural purposes includes a complex approval process, including:

conclusions from environmental assessments,
-
approvals from local self-government bodies,
-
approval by the State Forest Agency,
-
a decision by the Cabinet of Ministers of Ukraine (for state-owned lands).
