Privatization of a land plot
Ukrainian law provides that every citizen of Ukraine who has reached the age of 18 may acquire ownership of a state-owned or municipally owned land plot free of charge.
Moreover, not one but six land plots for different purposes, namely
- for farming
- for personal farming – no more than 2.0 hectares
- for gardening – no more than 0.12 hectares
- for the construction and maintenance of a residential building, outbuildings and structures (personal plot) in villages – no more than 0.25 hectares, in towns – no more than 0.15 hectares, in cities – no more than 0.10 hectares;
- for individual summer cottage construction – no more than 0.10 hectares;
- for the construction of individual garages – no more than 0.01 hectares.
The size of land plots transferred free of charge to a citizen for personal farming may be increased in case of receiving a land share (land plot) in kind (on the ground).
It is worth noting that during martial law, these rules do not apply and only the land on which your real estate is located can be privatized.
The procedure for privatization of the land plot under the house
- apply to the relevant organization for the development of land management documentation to establish/restore the boundaries of the land plot in kind (on the ground) with the intended purpose for the construction and maintenance of a residential building, outbuildings and structures.
- After the development of technical documentation on land management, the information is entered into the State Land Cadastre.
- submit an application to the local council for a decision of the session on the transfer of ownership of the land plot.
The application shall be accompanied by:
- a copy of the applicant’s passport and a certificate of TIN assignment;
- technical documentation on land management;
- extract from the State Land Cadastre;
- an exchange file created by a certified land surveyor).
- register the ownership of the land plot.
If you do not have any documents on the ownership of the building under which you want to legalize the land, you must first register the ownership of such real estate
Land privatization during martial law
Land privatization will be fully resumed after the end of martial law. Therefore, if you intend to privatize land that is not located under your building, now is the time to start looking for a suitable land plot.
The procedure for obtaining ownership of a land plot will be easier if such a land plot is in your use, in which case you contact a land management organization and develop technical documentation for such a plot and, with these documents, apply to the relevant local government body for approval and transfer of ownership of the land plot
If you want to privatize a land plot that is not in your use, the procedure is complicated by the fact that you need to find a free land plot. Although you have the right to privatize a land plot in any region of Ukraine, regardless of your place of registration, it is quite difficult to find a vacant land plot.
If you have found such a plot, you need to determine the intended purpose of the land plot, its approximate size and submit an application to the authorized body. The local government body is obliged to consider the application within one month and grant or refuse to grant permission to develop a land management project for the allocation of a land plot.
How to privatize a land share
In general, the registration of ownership of a land plot on the basis of a share certificate does not differ from ordinary privatization. It should be remembered that by January 1, 2025, you must assign a cadastral number to your share, otherwise the right to privatization will be lost.
