Ownership Rights to Land (Land Plot)

Ownership of a land plot is one of the fundamental property rights guaranteed by the Constitution of Ukraine (Article 14) and regulated by the Land Code of Ukraine (hereinafter – LCU). This right allows the owner to possess, use, and dispose of the land at their own discretion within the limits established by law.

Types of Ownership

In Ukraine, there are three types of land ownership:

  • Private — the right of individuals and legal entities.
  • Municipal — the right of territorial communities.
  • State — the right of the state.

The most common is private ownership, which is acquired through sale and purchase, gift, inheritance, privatization, etc.

Acquisition of Ownership Rights

The procedure for acquiring ownership is stipulated by Article 116 of the LCU. The main ways include:

  • Civil-law transactions (sale, gift, exchange).
  • Privatization of land plots used by citizens.
  • Inheritance according to the Civil Code of Ukraine.
  • Free transfer of state or municipal land within the limits provided by Article 121 of the LCU.

After acquiring the right, it is necessary to register the ownership in the State Register of Real Property Rights in accordance with the Law of Ukraine “On State Registration of Property Rights to Real Estate and Their Encumbrances.”

Documents Confirming Ownership

Key documents confirming ownership of a land plot include:

  • State act on ownership right (for older forms).
  • Extract from the State Register of Property Rights.
  • Sale-purchase agreement, gift agreement, certificate of inheritance.
  • Decision of the competent authority to transfer land ownership.

Restrictions on Ownership

Legislation provides for a number of restrictions, in particular:

  • Establishment of protected zones, sanitary zones, zones of limited activity.
  • Encumbrances (mortgages, servitudes, seizure).
  • Restrictions related to land categories as provided by Articles 19–22 of the LCU.

Important When Registering Ownership

When registering land ownership, it is advisable to:

  • Check the intended land use (according to the Land Use Classification).
  • Conduct a technical inventory and normative monetary valuation.
  • Order geodetic survey and cadastral plan development.
