Registration of Dual-Purpose Facilities (DPF)

In this article, we’ll explore what dual-purpose facilities (DPF) are, how the registration process works, what documents are required, key considerations for legal entities and individuals, and common mistakes to avoid. This material will be useful for developers, local authorities, and business representatives alike.

What Is a Dual-Purpose Facility?

Dual-purpose facilities are buildings that serve a regular function (e.g., residential, office, or administrative use) but can also be used to protect the population during emergencies (such as civil defense shelters). These facilities may include:

  • underground parking that can be converted into shelters;
  • basements or semi-basements of residential or administrative buildings;
  • multi-functional complexes with built-in protective features.

The legal framework is based on the Law of Ukraine “On the Legal Regime of Property Under Martial Law”, the Law “On Civil Protection”, and state construction standards DBN B.2.2-5:2023 “Buildings and Structures. Civil Protection Shelters”.

DPF Registration: Step-by-Step Guide

Registering a dual-purpose facility means listing it in the register of protective structures maintained by the relevant regional office of the State Emergency Service of Ukraine (SES).

1. Preparing Technical Documentation

Required documents include:

  • ownership documents for the facility;
  • BTI (Bureau of Technical Inventory) technical passport;
  • technical description of the facility, highlighting engineering systems and protective features;
  • expert opinion confirming compliance with DPF criteria;
  • evacuation plan and shelter usage instructions.

2. Submitting Documents to the SES

Documents are submitted to the SES’s main regional office (or city branch) either in paper or electronic form.

3. On-Site Inspection

SES specialists conduct an on-site inspection to assess whether the facility meets civil protection shelter requirements. The result is a formal inspection report.

4. Decision and Inclusion in the Register

If the facility passes the inspection, it is added to the regional or city list of civil protection structures. An official order is issued by the SES, and a confirmation document is provided to the owner.

Key Considerations for Legal Entities and Individuals

  • Legal entities (e.g., developers or management companies) are responsible for the technical maintenance and readiness of the facility, including regular inspections.
  • Individuals who own premises that can serve as a DPF can initiate the registration process but must provide technical confirmation of suitability.

Common Mistakes to Avoid

  • Missing technical documentation confirming compliance with DBN standards.
  • Using basements lacking ventilation or restrooms without appropriate modifications.
  • Not meeting the required shelter area per person.
  • Unclear or missing legal documentation of ownership, preventing registration.

Conclusion

Registering a dual-purpose facility is a necessary condition for its legal use in civil protection. This enhances the object’s safety status and helps avoid penalties or inspections. Working with experienced engineers and legal experts can streamline the process and reduce the risk of denial by the SES.
