Transferring a creative studio to an apartment

Converting a creative studio into an apartment is a procedure that allows you to change the functional purpose of a room that was previously used for creative activity into a living space.

This is an important legal step that requires compliance with a number of construction, sanitary and legal requirements.

Stages of transferring a creative studio to an apartment:

1. Assessment of compliance with housing standards

To be eligible for conversion to residential use, the premises must meet the requirements for residential premises. These requirements include:

  • Ventilation, natural light (windows must provide sufficient light).
  • Availability of water supply and drainage.
  • Electricity and, if possible, a heating system.
  • The premises must have an adequate living space and comply with building regulations regarding the minimum ceiling height and room size.

It is necessary to conduct a technical examination of the premises to determine its compliance with the requirements of living quarters.

2. Preparation of documents

To change the functional purpose of the premises, you need to collect a number of documents, in particular

  • A document confirming the ownership of the premises.
  • A technical passport for the premises issued by the BTI or a certified engineer.
  • Project documentation confirming the possibility of reconstructing the premises (if the transfer requires redevelopment or change of utility systems).
  • An application for changing the functional purpose of the premises.

3. Applying to local authorities

To start the transfer procedure, you need to apply to the executive body of the local council or other local government body with an application for transferring the creative studio to an apartment.
It is important to submit all prepared documents together with the application.

4. Approvals and permits

The local council or other authorities will check the submitted documents and may organize a commission to inspect the premises.
After the inspection and approval of compliance with all requirements, the local government decides to change the functional purpose of the premises from a creative studio to a residential apartment.

5. Registration of changes in the state register

After receiving the decision to change the functional purpose, you need to contact the state registrar to make changes to the state register of real rights to real estate.
After these changes are made, the premises are officially considered an apartment.

6. Advantages of transferring a creative studio to an apartment

  • The right to permanent registration (residence) in the premises.
  • Possibility to use the premises as a full-fledged residential space.
  • Increase in the value of real estate in case of sale.
  • Possibility to receive utility subsidies if the apartment is used for permanent residence.

Important points:

The premises must comply with sanitary and safety requirements for residential facilities.
Any reconstruction or redevelopment must be agreed with the local authorities and carried out in accordance with applicable regulations.
