Construction Permit for a Class CC3 Building

Consequence Class CC3 is the highest category of construction complexity according to national building standards. Construction of such facilities is allowed only with an official permit issued by the State Inspectorate of Architecture and Urban Planning of Ukraine (SIAUP / DIAM).

Which Facilities Are Classified as CC3?

According to DBN V.1.2-14:2018, CC3 includes:

  • high-rise residential and public buildings (from 9 floors or over 20 m);

  • shopping and entertainment centres, stadiums, railway stations, hospitals, schools;

  • facilities with large concentrations of people (over 400 persons simultaneously);

  • industrial facilities with elevated levels of risk;

  • buildings whose failure may cause significant social or environmental damage.

Who Can Obtain a CC3 Construction Permit?

According to the Law of Ukraine “On Regulation of Urban Development Activities”, the applicant may be:

  • an individual — the owner or user of the land plot;

  • a legal entity — developer, constructor, investor;

  • state or local self-government authorities.

Required Documents for Obtaining a Permit

To receive a construction permit for a CC3 facility, the applicant must submit the following documents to DIAM through the Unified State Electronic System in the Construction Sector (USESC):

  1. Application for issuing a permit (submitted electronically).

  2. Land ownership documents.

  3. Project documentation developed according to DBN standards, approved and validated.

  4. Expert report on the project documentation (mandatory for CC3).

  5. Notification about appointed responsible persons (technical supervision engineer, general contractor, etc.).

  6. Extract from the State Register of Property Rights (if needed).

  7. Proof of payment (for the expert review).

Project Documentation Expertise

For CC3 facilities, expert review is mandatory regardless of funding sources. It is performed by accredited expert organisations and includes:

  • compliance check with building norms (DBN);

  • environmental impact assessment;

  • compliance with fire, sanitary, technological and environmental safety requirements;

  • structural reliability calculations review.

Timeframe for Review

According to legislation, DIAM must:

  • review the application and documents within 10 business days;

  • if approved — enter the permit into the Construction Activity Register;

  • provide the applicant with an electronic permit extract.

If discrepancies or errors are found, the applicant receives a reasoned refusal and may reapply after corrections.

Common Mistakes When Submitting Documents

Developers often lose time and resources due to typical issues:

  • incomplete document package or missing signatures;

  • missing or invalid expert review report;

  • incorrect land ownership documentation (e.g., no cadastral number);

  • use of non-accredited project organisations.

Important: CC3 project design must be performed by licensed architects and engineers, and expert review must be conducted by certified organisations.

Liability for Unauthorized Construction of a CC3 Facility

Construction without a permit, even if land and project exist, is considered unauthorized. Consequences include:

  • administrative fines (up to 93,000 UAH);

  • impossibility of commissioning the facility;

  • risk of demolition by court decision;

  • refusal of financing or insurance by banks.
