Declaration of commencement of work

Before the amendments to the Law of Ukraine “On Regulation of Urban Planning” there was a three-stage system of authorization documents for the commencement of construction works, among which there was also a declaration on the commencement of construction works.

Thus, the customer had the right to perform construction works after:

• sending by the customer of the notification on the beginning of construction works to the central body of the state architectural and construction control – for objects, the construction of which is carried out on the basis of the construction passport
• registration of the declaration of the beginning of construction work by the state architectural and construction control body – for construction projects of I-III categories of complexity;
• issuance to the customer of a permit for the performance of construction works – for construction objects belonging to IV and V categories of complexity.

Currently, there is a two-stage system of authorization documents: notification of the commencement of construction works and authorization to commence construction works.

In addition, depending on their characteristics, construction objects are not classified according to five categories of complexity, as it was before, but are divided into three classes of consequences (responsibility): CC1, CC2, CC3. Accordingly, at present, the declaration on the commencement of construction works is not registered as a document authorizing the commencement of construction works.

However, in a number of cases, when construction started before the amendments to the law were made, there may be cases when such construction is carried out on the basis of the declaration on the commencement of construction works.

Currently, the basis for the commencement of construction works is either a notice of commencement of construction works and a permit to commence construction works.

Notice to commence construction

A notice of commencement of construction work is issued for small construction projects and, depending on the size of the construction project, may be submitted:

• on the basis of construction passport (for construction of individual (homestead) residential houses, garden, dacha houses economic buildings and structures, garages, elements of landscaping and gardening of the land plot, height not more than 2 floors + attic)
• on the basis of MBUO – for construction objects, which according to the class of consequences (responsibility) belong to objects with minor consequences CC1.

Permission to perform construction works is obtained for large objects, which according to the class of consequences belong to SS2 and SS3.
