How to put a summer house (garden house) into operation

The procedure for commissioning a summer house or garden house in Ukraine is similar to the commissioning of an ordinary private house, but it can be somewhat simplified, depending on the type of building and its area.

Here are the steps to follow:

1. Preparation of land documents

To put a summer cottage or garden house into operation, you need to have:

  • A document confirming the right of ownership or use of the land plot (state act, lease agreement, etc.).
  • The cottage must be built on land intended for gardening or summer cottage construction.

2. Obtaining a technical passport

After the construction is completed, you need to order a technical passport for the house from the relevant organization (usually the BTI or a private certified company). The technical passport describes the house plan, its area, number of floors and other technical parameters.

3. Filling out a declaration or certificate of readiness

Depending on the area and purpose of the building, it is required:

  • For houses up to 500 m² (classified as individual houses for gardening or country houses): submit a declaration of readiness for operation to the DIAM (State Architectural and Construction Inspectorate).
  • For houses over 500 m²: you need to obtain a certificate of readiness, which requires an inspection of the house by the SACI.

4. Submission of documents to the SACI

To put the house into operation, you must submit the following documents to the SACI:

  • Technical passport for the garden house.
  • A declaration of readiness (for houses up to 500 m²) or an application for a certificate of readiness (for larger houses).
  • Land title (ownership or use).
  • Project documentation, if it has been drawn up (for simpler houses, a project may not be required).

5. Obtaining a decision

After submitting the documents:

  • If a declaration of readiness is submitted, the SACI registers it and usually does not conduct additional inspections.
  • If a certificate is required, the SACI may inspect the facility to confirm its compliance with building regulations.

6. Registration of ownership

After putting the house into operation, you need to register the ownership of the garden house in the State Register of Real Property Rights. To do this, contact a state registrar or notary, providing documents for putting the house into operation and a technical passport.

Basic documents for putting a summer cottage into operation:

  • A document for the right of ownership or use of a land plot.
  • Technical passport for the house.
  • Declaration of readiness or certificate.
  • Project documentation (if any).

Additional points:

  • If the house was built unauthorizedly without proper permits, it is necessary to go through the process of legalizing the unauthorized construction.
  • To put into operation houses up to 500 m² under a simplified procedure, it is not always necessary to go through a lengthy process of obtaining certificates, which greatly simplifies the legalization process.

This procedure allows you to obtain an official status for your dacha or garden house, which is important for the possibility of selling it, inheriting it or other legal transactions.
