Early Termination of Land Lease Agreement

Lease relations regarding land plots in Ukraine are governed by the Civil Code of Ukraine, the Land Code of Ukraine, the Law of Ukraine “On Land Lease”, as well as other subordinate legal acts. One of the important aspects of these relations is the possibility of early termination of a land lease agreement.

Grounds for Early Termination

According to Article 31 of the Law of Ukraine “On Land Lease”, early termination of the lease agreement is possible:

  • by mutual consent of the parties;

  • by court decision in case of a material breach of the contract by one of the parties;

  • in other cases provided by law or the agreement.

Typical grounds include:

  • non-payment or delayed payment of rent;

  • use of the land not in accordance with its designated purpose;

  • deterioration of the environmental condition of the plot or its irrational use;

  • failure to fulfill obligations to maintain infrastructure facilities.

Termination Procedure

If the parties reach an agreement, the termination is formalized by signing a supplemental agreement to the lease contract. This agreement must be registered in accordance with the requirements of the Law of Ukraine “On State Registration of Property Rights to Real Estate and Their Encumbrances”.

In case of unilateral termination, one must file a claim in court. The claim must be accompanied by:

  • a copy of the lease agreement;

  • documents proving the breach of contract terms;

  • evidence of pre-trial dispute resolution attempts (correspondence, inspection reports, etc.).

Specifics for State and Communal Land

If the leased land belongs to the state or local communities, the termination must also comply with legal requirements. For instance, the landowner (regional, district, or city council) must adopt a decision that serves as the basis for registering the lease termination.

When terminating a contract early, one should consider potential risks such as fines or damages as stipulated by the contract. It is important to properly draft all documents and follow legal procedures to avoid the contract or court decision being declared invalid.
