How to lift the seizure of property?

A seizure of real estate can occur due to various circumstances, including

  • Debt on loans or other financial obligations. If the property owner fails to fulfill its financial obligations to the bank or other creditors, they may apply to the court to seize the debtor’s real estate.
  • Litigation. The seizure may be imposed as part of a court proceeding as an interim measure to guarantee the enforcement of a future court decision.
  • Enforcement proceedings. If there is a court decision on debt collection, the state executive service or private enforcement officers may seize the debtor’s real estate.
    Tax arrears. In case of non-payment of taxes, the tax authorities may initiate the seizure of property.

Algorithm of actions to lift the seizure of real estate

Removing a seizure from real estate requires a certain algorithm of actions. Here are the main steps to take:

  • Find out the reason for the arrest.
    Contact the authority that imposed the arrest (court, executive service, tax office) to obtain information about the grounds for the arrest.
  • Eliminate the reason for the arrest.
    Repayment of debts to creditors or tax authorities.
    Enforcement of a court decision or reaching a settlement agreement in court.
    Preparation of the necessary documents to confirm the elimination of the reason for the arrest.
  • Preparation of documents.
    Application for lifting the arrest.
    Documents confirming the fulfillment of financial obligations (receipts, payment orders).
    Copies of court decisions or other documents confirming the lifting of the arrest.
  • Submission of documents.
    Submit an application and all necessary documents to the authority that imposed the seizure.
    If the seizure was imposed by the executive service, the documents are submitted to the relevant department of the executive service.
  • Obtain a decision to lift the arrest.
    Contact the authority that imposed the seizure to obtain an official decision to lift the seizure of real estate.
    Register the lifting of the arrest in the registers.
    After receiving the decision to lift the arrest, you must contact the State Register of Real Property Rights to make the appropriate changes.
  • Control check.
    Check the relevant registers to ensure that the property is not under arrest to confirm that the procedure has been completed.
