Change of land use designation

Changing the designated purpose of a land plot is a legal procedure that involves changing the official status of land use as defined in the land cadastre.

It may be necessary when the owner or tenant plans to use the land plot for a purpose other than that specified in the documents. For example, transferring agricultural land to a building plot.

Reasons for changing the designated purpose of land:

  • Conversion of agricultural land to construction land for the construction of residential or commercial facilities.
  • Conversion of a land plot for construction for residential, industrial or commercial use.
  • Changing the category of land for recreational or economic use.
  • In other cases, when it is necessary to use the land for purposes other than its current purpose.

The main stages of changing the designated purpose of land:

1. Preliminary check of the possibility of changing the designated purpose

  • First of all, it is necessary to check whether a change of designated purpose is allowed for a particular plot. This depends on the master plan for the development of the territory and urban planning documentation approved by local authorities.
  • If the general plan or local development rules allow for a change of land use, you can start the procedure.

2. Preparation of documentation

You need to collect a package of documents to submit to the local authorities. Typically, these documents include:

  • A document confirming the ownership of the land plot (a state act or an extract from the state register of rights).
  • Cadastral number of the land plot (extract from the State Land Cadastre).
  • An application for changing the designated purpose of the land.
  • Land management project for changing the designated purpose of the land plot (developed by a certified land surveyor or company).

3. Development and approval of a land management project

After preparing the documents, it is necessary to develop a land management project to change the designated purpose. This project includes a plan for the future use of the land plot and its compliance with local development standards.
The project is approved by the local architecture and urban planning authorities.

4. Submitting an application to local authorities

An application for a change of designated purpose, together with a land management project, is submitted to the executive body of the local council or the relevant commission (depending on the location of the plot).
The local council considers the application and decides whether to approve or refuse the change of designation.

5. Obtaining a decision and registering changes

In case of a positive decision, the local council issues a decision to change the designated purpose of the land plot.
After obtaining this decision, it is necessary to apply to the state registrar to make changes to the State Register of Real Property Rights and the State Land Cadastre.

Important points:

  • General plan of the territory. Before starting the procedure, you should make sure that the general plan of the area allows for a change of land use.
  • Land management project. It is a key document that is developed by professionals and approved by local authorities.
  • Local regulations and restrictions. Some land may be restricted in use for certain purposes (protective zones, land for environmental protection, etc.).
