Extension of Land Lease Agreement

Extending a land lease agreement is an important legal process that ensures continued and stable use of the land plot. According to current Ukrainian legislation, the lessee has the right to renew the agreement if all stipulated conditions are met.

Legal Framework

The main legal acts governing the extension of land lease agreements include:

  • Land Code of Ukraine (Articles 126, 134, 141);
  • Civil Code of Ukraine (Article 777);
  • Law of Ukraine “On Land Lease”;
  • State Building Codes (depending on land use purpose — for example, DBN B.2.2-12:2019 for urban planning documentation).

Procedure for Lease Extension

1. Initiating the Process

According to Article 33 of the Law of Ukraine “On Land Lease”, the lessee must submit a written application to the lessor expressing the intention to extend the lease no later than one month before the expiration of the agreement.

2. Application Review

The lessor is obliged to review the application within the established timeframe and respond. If there are no objections, an additional agreement is signed to extend the lease term.

3. Registration

If the lease is extended for more than 5 years, state registration of the lease right is required in accordance with the Law of Ukraine “On State Registration of Property Rights to Real Estate”.

Automatic Renewal Clause

If the agreement includes a clause on automatic renewal for the same term and under the same conditions, and neither party objects, the lease is considered automatically extended (Part 6, Article 33 of the Law “On Land Lease”). It is important to check the wording of this clause to avoid legal disputes.

Grounds for Refusal

The lessor may refuse to extend the lease if:

  • the lessee has systematically violated the agreement terms;
  • the land plot is subject to withdrawal for public needs;
  • the lessor intends to change the designated purpose of the land.
