How to divide a house (household) into two separate ones

The procedure of dividing a house into several separate ones is becoming increasingly popular among owners of large houses.
There are economic reasons for such a division:
- large amount of real estate tax
- the cost of utilities
- the amount of tax for the land plot
And personal or commercial reasons:
- when several families live in the same house and they want to divide the house into separate objects for each family

How to start the division?
Prerequisites for dividing a house:
- availability of documents of ownership of the house ;
- availability of documents of ownership of the land plot;
- availability of the technical possibility of dividing the house and the land plot;
- The land plot that will be assigned to each newly created independent object must have an independent exit to the street (alley, square, etc.) with a width of at least 3.5 meters or the possibility of organizing a joint entrance. For the maintenance of buildings and their routine repair, the distance to the border of the neighboring plot from the most protruding wall structure must be at least 1 meter. It is not allowed for a land plot or its parts to belong simultaneously to two (or more) newly formed independent objects.
If one of these documents is missing, it is necessary to first execute such a document.
Grounds for division of real estate
The basis for dividing a house into separate ones is a conclusion on the technical feasibility of dividing a real estate object, which, in particular, must contain the following information:
- information on the documents certifying the ownership of the real estate object
- technical characteristics of the real estate object;
- information on the document certifying the right of ownership or use of the land plot;
- number of newly created real estate objects;
- composition of each newly created real estate object;
- the option of dividing the real estate object.
When performing work to determine the technical feasibility of division, the contractor analyzes the composition of the real estate object, namely: the number of main residential buildings, buildings, outbuildings and structures, and its characteristics. If the real estate is jointly owned, it is necessary to obtain a statement from all co-owners regarding the division. An alternative is a notarized agreement or a court decision on the procedure for using residential buildings, outbuildings and structures.
What is the procedure for dividing a house into several separate ones?
- Obtaining a Conclusion on the technical feasibility of dividing the house, which is issued by business entities that employ engineers with the appropriate qualification certificate (in particular, GlobalBud Ukraine)
- Approval by the owner (co-owners) of the division of property by signing an application for division of property or notarization of the agreement. In the absence of the co-owners’ consent, the division may be carried out on the basis of a court decision.
- Obtaining a technical passport for each newly created building
- Obtaining a decision from the authorized local government body on the assignment of a postal address to the newly created houses
- Obtaining an extract on the registration of ownership of individual houses in the State Register of Real Property Rights
Please note that if there are unauthorized or completed objects on the land plot or redevelopment of the property to be divided, before such division, you must first legalize the unauthorized construction.
