Appealing a Building Permit Denial

Appealing a building permit denial is an important procedure that allows the applicant to protect their rights and interests in cases of unlawful or unsubstantiated actions by state architectural and construction control authorities. A permit denial can lead to delays in project implementation, financial losses, and complications with fulfilling contractual obligations.

Reasons for Permit Denial

According to Article 37 of the Law of Ukraine “On Regulation of Urban Planning Activities”, the grounds for denying a building permit may include:

  • Submitting an incomplete document package;

  • Non-compliance of project documentation with State Building Standards (DBN);

  • Providing false information in the documents;

  • Violations of urban planning conditions and restrictions.

How to Appeal the Denial

The appeal procedure is provided for by the Code of Administrative Procedure of Ukraine, as well as by internal regulations of DABI (currently DIAM). There are two main ways:

1. Administrative Appeal

This involves submitting a complaint to the higher authority or official who issued the denial. The complaint should include:

  • A description of the situation;

  • Justification of the unlawfulness of the denial;

  • Copies of the submitted documents;

  • References to the legal norms that were violated.

2. Judicial Appeal

This involves filing an administrative lawsuit with the district administrative court. The plaintiff must prove:

  • Violation of their rights;

  • Unjustified nature of the denial;

  • Compliance of the submitted documents with current legislation.

If the court rules in favor of the applicant, the authority must cancel the denial and issue the construction permit.

What to Consider When Preparing an Appeal

  • Check your documents for compliance with DBN A.2.2-3:2014 (composition and content of project documentation).

  • Collect all written denials, official letters, and notifications.

  • Include technical conclusions or expert reports that confirm the legality of your actions.
