Recognition of ownership by prescription
Acquisitive prescription is a legal mechanism by which a person may acquire ownership of property if he or she has been in possession of that property for a long time in good faith and without interruption.
Recognition of ownership by prescription is a relevant issue in cases where a person actually owns real or personal property but does not have official documents for it.
What is an acquisitive limitation period?
The statute of limitations is a period during which a person owns someone else’s property as his or her own, which enables him or her to acquire ownership of the property after the expiration of this period. According to the Civil Code of Ukraine, the statute of limitations for real estate is 10 years, and for movable property – 5 years.
The main conditions for acquiring ownership by prescription are:
- Good faith possession. The person must be convinced that he or she owns the property legally and not know that another person has rights to the property.
- Open possession. The person must own the property publicly, without concealing this fact from others.
- Continuous possession. The possession must be permanent, i.e. the person must use the property without interruption for a specified period of time.
Recognition of ownership by acquisitive prescription in court
In order to officially acquire ownership under the prescription, a person must apply to a court. The procedure includes the following steps:
- Preparation of a statement of claim. The person claiming ownership must file a statement of claim with the court, which must contain all the circumstances confirming bona fide, open and continuous possession of the property for the required period.
- Providing evidence. The court must be provided with evidence of actual possession of the property. This may include witness statements, documents confirming payment of utilities, property maintenance, etc.
- Consideration of the case by the court. The court considers all the evidence provided, hears the parties and makes a decision on the recognition of ownership by acquisitive prescription.
- Decision-making by the court. If the court finds that all the conditions of the statute of limitations are met, it decides to recognize the ownership of the property by way of the statute of limitations. The decision can then be registered in the State Register of Rights to Real Estate.
