Main types of permits in construction

1. Urban planning conditions and restrictions (UPC)

3. Declaration or permit for construction works

Pursuant to the Law of Ukraine “On Regulation of Urban Development Activities”, a declaration or a permit must be submitted for the construction of objects of different classes of consequences (liability):

For minor class (CC1) facilities, a declaration of commencement of construction works is required;
for objects of medium and significant class (CC2 and CC3), it is necessary to obtain a permit for construction works from the State Inspection of Architecture and Urban Development of Ukraine (SIAU).

4. Expert report

Expert review of project documentation is mandatory for facilities of medium and significant consequence class (CC2, CC3). It is carried out to assess the project’s compliance with building codes, technical regulations, and other legal requirements. The result is an expert report confirming the feasibility of the project.

5. Permission to carry out high-risk work

If high-risk work is planned during the construction process (e.g., work at height, use of special equipment, etc.), it is necessary to obtain a permit from the State Labor Service of Ukraine.

Liability for lack of permits

Construction without proper permits can lead to serious legal consequences. According to the Code of Administrative Offenses of Ukraine and the Criminal Code of Ukraine, administrative and criminal liability is imposed for violation of construction standards and construction works without proper permits. This may include fines, termination of construction, and in some cases even demolition of illegally constructed facilities.
