Permission for Remodeling

Remodeling of premises in an apartment or non-residential building is a common practice among property owners. However, to carry out such work, it is necessary to comply with legal regulations and obtain the appropriate permit. In this article, we will consider what changes are considered remodeling, how to obtain a permit, and what consequences may arise if one is not obtained.

What is Remodeling?

Remodeling is a change in the configuration of a room without affecting the building’s load-bearing structures. It may include:

  • demolition or construction of partitions;
  • changing the location of doorways;
  • combining rooms;
  • arranging bathrooms in a new location.

If the work involves interference with load-bearing walls, changes to the facade, or communications, it is considered reconstruction, which requires a more complex approval process.

Is a Permit Required for Remodeling?

According to State Building Norms (DBN), minor remodeling within an apartment that does not affect load-bearing structures or engineering networks may be performed without obtaining a permit. However, in some cases, approval from local authorities or the building management company is required.

If the remodeling affects load-bearing elements or changes the functional purpose of the premises, it is necessary to:

  1. Order project documentation from a certified architect or design organization.
  2. Obtain a technical assessment on the feasibility of the work.
  3. Register a notification or obtain a permit from the State Inspection of Architecture and Urban Planning (DIAM).
  4. Make changes to the technical passport after completing the work.

Consequences of Illegal Remodeling

If remodeling is carried out without the necessary permits, it may lead to:

  • fines according to the Code of Administrative Offenses of Ukraine;
  • an obligation to restore the premises to its original state;
  • problems when selling or gifting the property, as changes will not be reflected in the documentation.
