Land Disputes

Land disputes are among the most common types of legal conflicts in the real estate sector in Ukraine. They concern issues of ownership rights, land boundaries, land use, lease agreements, easements, as well as appeals against decisions of local or state authorities regarding land matters.

Given the complexity of legal regulations in the field of land relations, court proceedings in this area require a deep understanding of the Land Code of Ukraine, the Civil Procedure Code of Ukraine, as well as specialized rules, such as the State Building Codes (DBN) in the case of technical boundary examinations.

  1. Disputes over ownership or use of land plots

  2. Boundary determination or restoration disputes
    These often arise during cadastral surveys or property reconstruction. Relevant regulations include DBN B.1.1-14:2012 “General Plan Composition and Content for Settlements”.

    Such as unlawful allocation or withdrawal of land plots, or changes in designated land use.

  4. Disputes related to land lease agreements
    These typically involve contract extensions, changes in terms, or unilateral termination.

  5. Easement disputes
    Conflicts related to rights of passage, access, or laying utilities through another’s land.

Procedure for Resolving Land Disputes

Most land disputes are resolved through civil or administrative proceedings. The key stages include:

  • preparation and submission of the claim;

  • collection of evidence (ownership documents, technical reports, expert conclusions);

  • court hearing;

  • enforcement of the court decision.
