Construction in the Coastal Protective Zone

Construction within a Coastal Protective Zone (CPZ) is a complex process that requires strict compliance with legal regulations and building codes. Violations can result in serious legal consequences, including construction halts and fines.

Definition of a Coastal Protective Zone

A Coastal Protective Zone is a land area along the shores of water bodies with a special land-use regime aimed at protecting water quality and preventing pollution. The width of a CPZ depends on the type of water body:

  • For small rivers and streams — at least 25 meters.
  • For medium rivers — at least 50 meters.
  • For large rivers, reservoirs, and lakes — at least 100 meters.

These requirements are established by Article 60 of the Land Code of Ukraine and Article 88 of the Water Code of Ukraine.

Construction Restrictions in CPZ

According to current legislation, the following activities are prohibited within CPZs:

  • Construction of any structures, except hydraulic, hydrometric, and linear engineering communications.
  • Storage of fuel, lubricants, fertilizers, pesticides, and other chemicals.
  • Grazing livestock and plowing the land.

These restrictions are intended to preserve ecological balance and prevent water pollution.

Required Permits and Approvals

To carry out construction work in the CPZ, you must:

  1. Obtain approval from the water resource management authorities (per Article 86 of the Water Code of Ukraine).
  2. Develop and approve a land management project considering CPZ specifics.
  3. Obtain a construction permit from the State Architectural and Construction Control authority.

Failure to comply may result in the construction being deemed illegal and subject to demolition.

In February 2025, a complaint was filed with the Dnipro City Building Control Authority regarding violations during construction in the CPZ of Lake Moskovske. The violations included:

  • Non-compliance with building documents and land designation.
  • Construction in a water zone without an approved project for CPZ work.
  • No approval from the water resources authority.

This case highlights the importance of legal compliance when planning construction in CPZs.
