Privatization of housing (apartments)
Privatization of an apartment is the process of acquiring ownership of state-owned or municipally owned housing by Ukrainian citizens. This procedure is regulated by the Law of Ukraine “On Privatization of the State Housing Fund” and other regulations.
Who is eligible for privatization?
Citizens of Ukraine who permanently reside in an apartment on legal grounds can privatize it, including:
- Tenants who have a rental agreement.
- Tenant’s family members (spouses, children, parents, other persons permanently residing in the apartment).
- Citizens living in service housing or dormitories (under certain conditions).
It is worth noting that every citizen is entitled to free privatization within the standard of 21 m² per person + 10 m² per family.
What objects are subject to privatization?
The following are subject to privatization:
- apartments in the state and municipal housing stock;
- rooms in dormitories (under certain conditions);
- service apartments, if they have lost their service status.
Not subject to privatization:
- emergency housing;
- apartments in closed military camps;
- apartments located in museum buildings or architectural monuments.
The procedure for privatizing an apartment
Collection of necessary documents:
- application for privatization;
- copies of passports and identification codes of all residents;
- technical passport for the apartment;
- certificate of family composition (Form No. 3);
- a document confirming the right to use the apartment (warrant, lease agreement, etc.);
- a certificate stating that the applicants have not exercised the right to free privatization.
Submission of documents to the local government (ASC or privatization department).
Preparation of technical documentation (in case of its absence) and valuation of the property.
Obtaining a decision on privatization.
Registration of ownership in the State Register of Real Property Rights.
Is it possible to privatize an apartment without a technical passport?
No, a technical passport is a mandatory document for privatization. If you do not have one, you must contact the BTI or a certified organization to have a new technical passport issued.
Is it possible to alienate a non-privatized apartment?
Without privatization, housing remains in the ownership of the state or community. This means that you will not be able to sell, donate or inherit it.
How long does privatization take?
The duration of the procedure depends on the readiness of the documents. On average, it takes from 1 to 6 months.
