How to put a house into operation
After the construction of a private house or an apartment building is completed, one of the most important stages is its commissioning.
This procedure is mandatory because without it, the building is not considered legally complete and cannot be used for its intended purpose. Let’s take a closer look at how to properly formalize commissioning in Kyiv and Kyiv region.
1. Preparation of documentation
Before submitting an application for commissioning, you must prepare all the necessary documents. This list includes:
- Documents for the ownership or lease of the land plot on which the building is located;
- Project documentation, which must be approved in accordance with the DBN (State Construction Norms of Ukraine);
- A document confirming the completion of construction – an act of readiness of the object for operation;
- Technical passport of the building, prepared by the BTI;
- Report on the implementation of technical supervision and report on the implementation of author’s supervision, if provided for by the project terms;
- Conclusion on the compliance of the construction with the DBN.
2. Obtaining a certificate of readiness
Upon completion of the construction of the facility, it is necessary to obtain a certificate of readiness for operation. This document confirms that the building was constructed in accordance with the DBN and project documentation.
It is issued by the State Inspectorate of Architecture and Urban Planning (SIAP) or other authorized bodies after checking the submitted documents and the facility for compliance with legal standards.
3. Applying to the SACI or ASC
In order to obtain a commissioning permit, you must submit an application to the relevant authority. In Kyiv and Kyiv region, this may be the SACI or the Center for the Provision of Administrative Services (CPAS). The application must be accompanied by:
- Certificate of readiness of the facility for operation;
- Technical passport;
- Documents for the land plot;
- Results of technical and author’s supervision.
4. Inspection of the object by the commission
After submitting the application, the date of the house inspection is set. Specialists check the compliance of the object with building codes and submitted documents. If everything complies with the standards, the facility will be approved for commissioning.
5. Obtaining a decision on commissioning
In case of a positive inspection result, the customer receives a decision to put the facility into operation. This decision is the basis for registering the ownership of the real estate object in the State Register of Real Estate Rights.
What if the construction was carried out without a permit?
If a building was constructed without a building permit, it can be legalized through the so-called “construction amnesty”. This is a special procedure for commissioning unauthorized facilities that applies under certain conditions and restrictions set forth by law.
Important nuances:
- The commissioning procedure is simplified for buildings of up to 500 m²;
- Any changes to the project during construction must be approved additionally, otherwise it may result in a refusal to commission;
- The commissioning process can take from several weeks to several months, depending on the complexity of the project and the availability of the necessary documentation.
