Obtaining a Permit for Works in Heritage Protection Zones

Construction, renovation, or landscaping works in historical city areas or near architectural monuments require a special approach. According to the legislation of Ukraine, any intervention within heritage protection zones is allowed only with an official permit from the cultural heritage protection authority. Violation of this requirement may result in fines, suspension of works, or even criminal liability.

What Is a Heritage Protection Zone

According to the Law of Ukraine “On the Protection of Cultural Heritage”, protection zones are areas where restrictions are established for new construction, reconstruction, landscaping, and any other activities that may affect a cultural heritage site.
Main types of zones:

  • Protection Zone — the immediate surroundings of a monument where any work is prohibited without a special permit.

  • Construction Regulation Zone — an area where limited construction is allowed, taking into account the historical and architectural environment.

  • Protected Landscape Zone — a natural environment important for preserving the historical appearance of the area.

  • Archaeological Protection Zone — sites of potential or confirmed archaeological value.

When a Permit Is Required

A permit is required in the following cases:

  • carrying out construction, earthwork, or renovation within protection zones;

  • installing temporary structures, advertising, or engineering networks;

  • restoration, conservation, rehabilitation, reconstruction, or remodeling of buildings of historical value;

  • laying utilities, landscaping, or altering the terrain.

Procedure for Obtaining a Permit

The procedure is defined by Articles 22–25 of the Law “On the Protection of Cultural Heritage” and relevant Resolutions of the Cabinet of Ministers of Ukraine.

Stage 1. Preparation of Initial Documents

  • ownership documents for the land plot or facility;

  • a situational plan showing the plot boundaries;

  • a historical and architectural reference plan (if available);

  • project documentation approved by the architectural authorities;

  • an archaeological expert’s conclusion (if required).

Stage 2. Submitting the Application

The application is submitted to the Department of Cultural Heritage Protection (in Kyiv — the Department of KCSA) or the relevant unit of the Regional State Administration.

Stage 3. Review and Approval

The cultural heritage protection authority reviews the documents and may request additional materials or expert opinions.

Stage 4. Receiving the Permit

If the project complies with heritage protection requirements, the applicant is issued a permit for works within the protection zone. The permit is usually valid for up to one year, with the possibility of extension.

Liability for Violations

Carrying out works without a permit entails:

  • fines for legal entities up to UAH 170,000;

  • an obligation to restore the damaged object or its elements;

  • suspension of construction until all approvals are obtained;

  • in case of significant damage — criminal liability under Article 298 of the Criminal Code of Ukraine.
