Construction amnesty
The construction amnesty (dacha amnesty) is a procedure for legalizing unauthorized real estate that was built without obtaining the relevant permits. This initiative allows real estate owners to legalize their properties, avoid fines and obtain official ownership documents.
What is subject to the construction amnesty?
According to Ukrainian law, the construction amnesty applies to:
- Private residential buildings, garden and country houses built before August 5, 1992.
- Individual residential, garden, and country houses with a total area of up to 500 square meters, as well as outbuildings and structures built between August 5, 1992, and April 9, 2015.
- Outbuildings (garages, sheds, summer kitchens, etc.) that do not exceed the established parameters in accordance with applicable regulations.
Requirements for buildings
To be legalized, a building must meet the following criteria:
- No violations of urban planning norms and rules (DBN).
- Location of the facility on a land plot whose intended purpose is consistent with the development function.
- Construction works are carried out without threat to the environment.
Legalization procedure
- Apply to the State Inspection of Architecture and Urban Development (SIAU). Submit a declaration of commissioning.
- Preparation of technical documentation. Order a technical passport from a certified engineer or BTI.
- Conduct a technical inspection. Inspection of the facility for compliance with the DBN and operational safety.
- Obtaining documents. After verification and approval of the submitted documents, a certificate or other document confirming the legalization of the facility is issued.
Legal framework
The construction amnesty is regulated by the Law of Ukraine “On Regulation of Urban Development” and relevant resolutions of the Cabinet of Ministers of Ukraine. The procedures are also approved by Order of the Ministry of Regional Development of Ukraine No. 79 dated 03.07.2018.
