Changing the Designated Purpose of Agricultural Land to Residential Construction

In Ukraine, land plots have a designated purpose that defines their permissible use. One of the most common scenarios is changing the designated purpose from personal agricultural use to land for the construction of residential buildings and auxiliary structures. This procedure is complex and governed by several legal regulations.

Legal Framework

The change of land designation is regulated by:
  • Land Code of Ukraine (Articles 20, 186),
  • Law of Ukraine “On Regulation of Urban Development”,
  • State Building Standards (DBN), in particular DBN B.2.2-12:2019 on territorial planning.

What is Agricultural Land (Personal Use)?

This type of land is intended for:
  • growing crops,
  • raising livestock,
  • maintaining a personal household.
Such land is not meant for the construction of capital structures intended for permanent residence, except for small utility buildings.

When Is a Change Required?

You need to change the land designation if you plan to:
  • build a residential house or cottage,
  • conduct commercial development (e.g., shop, office, car service station),
  • obtain a building passport or urban planning conditions.

Procedure for Changing Land Designation

  1. Development and approval of a detailed territorial plan (DTP) — mandatory in most cases (Article 24 of the Law of Ukraine “On Regulation of Urban Development”).
  2. Submitting an application to the local council (for individuals) or to the Regional State Administration (for land outside settlements).
  3. Preparation of land management documentation — a land use project for changing the designated purpose.
  4. Approval of the documentation by authorized bodies (architecture, ecology, StateGeoCadastre).
  5. Adoption of a decision by the competent authority.
  6. Updating the State Land Cadastre.
  7. Updating the State Register of Property Rights.

Costs and Timeframes

  • The procedure takes approximately 2 to 6 months.
  • The cost depends on location, land area, need for DTP development, etc.

Potential Difficulties

  • Lack of a detailed plan or master plan.
  • Zoning restrictions preventing the change.
  • Rejection of documentation approvals.
