Building commissioning
Commissioning of a building is the final stage of construction, which confirms the compliance of the object with construction norms, design documentation and allows it to be officially used for its intended purpose. Without this stage, it is prohibited to register ownership of real estate or legally use the object.
What is commissioning?
According to the Law of Ukraine “On Regulation of Urban Planning Activities”, commissioning of an object is the process of official recognition of the object as built in accordance with the current legislation, the norms of the BIP, the project and permits, and allowed to be used for its intended purpose.
Procedure for commissioning a building
The procedure depends on the class of consequences (responsibility) of the object (CC1, CC2, CC3). The most common cases are SS1 (private houses, summer residences, outbuildings) and SS2 (apartment buildings, offices, shopping malls, etc.).
Preparation of a package of documents:
- Application;
act of readiness of the object for operation;
technical passport;
certificate of conformity (for CC2-CC3);
copy of the permit to perform construction works. - Submission of documents via CNAP or electronic user’s cabinet in EDESSB.
- Receipt of the document on commissioning:
registration of the declaration (for CC1); - Obtaining a certificate (for CC2-CC3).
- Registration of ownership right in the State Register of Rights in Rem.
Frequent mistakes when commissioning an object
Absence or errors in the technical passport.
Inconsistency between the actual construction and the project.
Untimely or incorrect submission of documents.
Ignoring the certification requirement (for CC2-CC3).
Unauthorized construction without a permit – such an object is subject to legalization through the court or legalization procedure.
