Apartment Division: Legal and Technical Aspects
Apartment division is a legal and technical procedure that allows dividing one residential unit into two or more separate real estate objects, assigning each of them individual ownership rights. Such division can be carried out either by agreement of the co-owners or by a court decision. Let’s review the key aspects of this procedure.
Grounds for Apartment Division
An apartment may be divided in the following cases:
- division of joint or shared ownership among co-owners
- distribution of inherited property among heirs
- sale of a share in the apartment by one of the co-owners
- need to create a separate real estate object for reconstruction or renovation purposes
Legal Aspects
First, it’s necessary to determine the legal status of the apartment and whether it is technically feasible to divide it. If the apartment is in shared ownership, the consent of all co-owners is required to proceed with the division.
If agreement cannot be reached, the matter is resolved in court according to Article 364 of the Civil Code of Ukraine. In court-based division, an expert assessment is conducted, and the court makes a decision based on the expert’s findings. It’s also important to note that the division must comply with housing, sanitary, and fire safety regulations.
Technical Requirements
To divide an apartment, a technical report on the feasibility of division must be prepared. This report is based on an inspection of the property and compliance with building regulations. The main regulatory documents used in this process are:

After redevelopment (if needed) and issuance of a new technical passport, one should apply to the local self-government body or Administrative Service Center (CNAP) to register the new real estate objects.
Registration of New Real Estate Objects
Once the physical division is completed, you must contact a notary or state registrar to update the State Register of Property Rights. The following documents are required:
- technical documentation
- ownership confirmation documents
- court decision (if applicable)
- application for registration
