Conversion of a garden or country house into a residential building
Conversion of a garden or country house into a residential property is a process that allows you to use such property for permanent residence and obtain all the relevant rights and obligations associated with residential real estate.
This procedure in Ukraine is regulated by a number of regulations and has several important steps.
1. Assessment of compliance with residential standards
A garden or country house must meet the requirements established for residential buildings.
Requirements for a residential building:
- Permanent water supply and drainage.
- Availability of electricity and, if possible, gas supply.
- Availability of a heating system to ensure a comfortable temperature in winter.
- Compliance with the minimum floor area and ceiling height.
- The house must be habitable all year round.
2. Preparation of documents
- To start the transfer procedure, you need to prepare a package of documents, in particular
- A document of ownership of the house and the land plot on which the house is located.
- Technical passport of the building, which is issued by the BTI or a private certified engineer.
- An application for transferring a house from a garden or country house to a residential one.
- Documents on putting the house into operation (if the house is newly built).
3. Technical inspection and examination
- If the house has already been built but not put into operation as a residential building, a technical inspection may be required.
- An engineer is involved to confirm that the building meets the requirements for residential premises.
- If necessary, additional examinations may be conducted (for compliance with sanitary and environmental standards).
4. Applying to local authorities
After preparing all the documents, you apply to the executive committee of the local council or to the relevant local government body with an application for the transfer of the house to residential use.
Along with the application, you must provide all the necessary documents confirming that the house meets housing standards.
5. Decision of the local self-government body
The local council makes a decision based on the review and verification of the submitted documents.
If all the requirements are met, a decision is issued on the conversion of a garden or country house into a residential building.
6. Registration of ownership
After receiving the decision of the local government, you must contact the state registrar to make changes to the real estate register.
The registrar will make changes to the state register of real rights, and the house will be registered as a residential one.
7. Obtaining a residence permit
After the house is converted into a residential building, you have the opportunity to register your place of residence in this building, which may be important for obtaining certain rights and benefits.
Advantages of converting a house into a residential one:
- Possibility of permanent registration (residence) in the house.
- Registration of a house as a residential building makes it possible to receive subsidies and benefits for utilities.
- Increase in the value of the house in case of sale.
- Compliance of the house with the requirements for its use as a dwelling.
