Obtaining Urban Planning Conditions and Restrictions
Urban Planning Conditions and Restrictions (UPCR) are documents that outline the key planning and construction requirements for a land plot in accordance with urban planning documentation. This document is mandatory for developing design documentation for construction, reconstruction, or major repairs of a property.
Why are UPCR needed?
UPCR are required to:
- define the construction boundaries;
- consider restrictions such as height, density, protection zones, etc.;
- ensure alignment with the local urban development policy;
- obtain a building permit later on.
Who issues UPCR?
Urban Planning Conditions and Restrictions are issued by:
- local self-government authorities (executive committees of city councils);
- in the case of Kyiv – the Department of Urban Development and Architecture of the Kyiv City State Administration.
Required Documents
To obtain UPCR, you need to prepare:
- Application from the client;
- Title documents for the land plot;
- Copy of the extract from the State Land Cadastre;
- Topographic and geodetic survey at 1:500 scale;
- Conceptual design proposals (if required);
- Certificate on the presence or absence of land use restrictions.
Issuance Timeframe
UPCR are issued within 10 business days from the date of submission of the complete document package. In case of refusal, the authority must provide a written explanation.
Important Notes
- If your construction intentions change (e.g., number of floors or function), UPCR must be updated.
- If the land plot has protection restrictions (e.g., located in a historical area), additional approvals may be required.
